Moving on to some tantalising caselaw, we start with a Court of Appeal ruling which upholds a previous High Court ruling in respect of non-compete clauses, what’s of note is the consideration of the employee’s financial situation when considering the application of damages.(6) Next we look at the impact of the Harper Trust v Brazel case on holiday pay for football staff.(7) The Court of Appeal has overturned the High Court decision on ‘fire-and-re-hire’.(8) In a case with wide ranging implications, a care worker who refused a COVID vaccination on religious grounds has won her discrimination claim.(9) A woman who claimed age discrimination against Domino’s pizza has settled her claim.(10) It seems that age discrimination is all the rage this week, with two more cases here.(11) Carlsberg has been fined £3m after a fatal ammonia leak in 2016 killed one person an injured many more.(12)
