Employee Membership Terms of Service

1. Terms

By accessing the website at https://castleassociates.org.uk/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law. We are a consultancy providing professional advisors and representatives for the internal process. We are, however NOT a firm of solicitors.

2. Definitions

“Castle” means Castle Associates, 28A Musters Road, West Bridgford, Nottingham NG2 7PL

“The client” means the individual set out on the Application Form overleaf under the section headed “Personal information”.

“Castle Associates Advisor” means the advisor who shall provide advice to the client.

2a. Services

 

 In consideration of the fees set out in paragraph 3 below, Castle will provide to the client the service specified overleaf being (1) “Silver service” 20 mins telephone advice daily only* during opening hours, on employment issues at work.  (2) “Gold service*” includes 60 mins telephone advice daily max 20 mins per call benefits plus 50% discount on direct representation after 3 months fees on all new issues. (3) “Platinum service*” includes unlimited telephone advice max 20 mins per call and representation is free after 3 months fees on all new issues. (See supporting information for further detailed explanations of services)  

New issues are defined as anything new or any issue that has recently happened or was started after the qualifying date and did not exist before the qualifying date. This would be any issue: raising a grievance or the start of any investigation whether capability, disciplinary or redundancy.

Castle shall endeavour wherever possible to provide such assistance and advice from the same advisor although Castle at its sole discretion reserves the right to provide an alternative Castle advisor for whatever reason. 

3. Payment and Duration

This contract will commence from the date of the first payment and will last for a minimum period of 1 year from that date.

In regards to the Gold and Platinum service this service is only available to clients in England; the client will need to be a member for a minimum of 3 months from date of first payment before the discounted representation is provided on all new issues. Early cancellation of contract will leave the client liable for the total costs of any trade union representation provided. Also failure to maintain regular monthly payments you will incur  an administration charge of £5 for every failed payment and would stop the member receiving the discounted representation and if fees are reinstated it would be deemed as the membership starting again and they would be treated as a new member.

Silver membership has no contract period and can be cancelled giving 1 month’s notice.

Castle reserves the right to increase the amount of monthly subscription fee but only in circumstances where any overheads of Castle have increased due to unforeseen circumstances. No such increase in the monthly subscription fee will be affected without providing the client with 30 days written notice.

The client shall have the right to terminate this contract up to 14 days from its first payment date if the service is used within the first 14 days you waiver the right to the 14 day cooling off period after this time cancellation will be after a 12 month period from the date of first payment; this will be done by providing Castle with three months written notice. Upon such termination, after the 14 day cooling off period, the client will be liable for payment of the monthly subscription fee in respect of any unexpired terms of this agreement together with interest on such sum at the rate of 8% per annum or any fee accumulated costs in regard to direct representation.

Castle will be entitled to terminate the Agreement in the event that the client has breached any term of this contract to include but not limited to a failure to disclose all relevant material or in circumstances where the client has hindered any case or issue or where the client has failed to follow any advice provided by Castle, its Castle Advisor or any other agent or advisor of Castle. In these circumstances, the client will be responsible for payment of monthly subscription in respect of any unexpired term of this Agreement together with interest on such sum at the rate of 8 %per annum.

At the expiry of the one year period from the date of the first payment, this contract will automatically renew for a further period of one year.

If we have to issue court proceedings against the client for non-payment of membership fees this will incur administration charges of £250 plus court costs.

Without prejudice to our other rights and remedies under these terms and conditions, if any sum payable is not paid on the due date, we shall be entitled forthwith to suspend or cancel the provision of services to you.

4. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Castle Associates Employment Law Limited's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials

  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial)

  • attempt to decompile or reverse engineer any software contained on Castle Associates Employment Law Limited's website

  • remove any copyright or other proprietary notations from the materials

  • transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Castle Associates Employment Law Limited at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

5. Disclaimer

The materials on Castle Associates Employment Law Limited's website are provided on an 'as is' basis. Castle Associates Employment Law Limited makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Castle Associates Employment Law Limited does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

6. Limitations

In no event shall Castle Associates Employment Law Limited or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Castle Associates Employment Law Limited's website, even if Castle Associates Employment Law Limited or a Castle Associates Employment Law Limited authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of materials

The materials appearing on Castle Associates Employment Law Limited's website could include technical, typographical, or photographic errors. Castle Associates Employment Law Limited does not warrant that any of the materials on its website are accurate, complete or current.
